By registering for any KDA drop-in, clinic, school programme, league or tournament, you confirm you have read and accepted this waiver. It applies each time you register and take part.
Dodgeball is a fast, physical sport played indoors on a hard court. It involves running, sudden changes of direction, diving, and being struck by a thrown ball. Contact with other players, the floor, walls and equipment happens routinely.
Injuries that can occur include, but are not limited to:
Serious injury is uncommon but possible. You accept these risks as part of taking part.
By registering, you confirm that:
To the extent permitted by the laws of Malaysia, and subject to the jurisdiction of the courts of Sarawak, you agree that you take part at your own risk, and that neither Kuching Dodgeball Association nor its committee members, volunteers, referees or venue partners are liable for injury, loss or damage arising from your participation.
Nothing in this waiver excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence where the law does not permit its exclusion. Signing this waiver does not remove KDA's responsibility to run sessions with reasonable care.
If any part of this waiver is found invalid or unenforceable, the rest of it continues to apply.
You agree to indemnify Kuching Dodgeball Association, its committee members and volunteers against any claim, cost or expense they reasonably incur because of your own act or omission, including a breach of this waiver or the Code of Conduct. This does not apply to claims arising from KDA's own negligence.
The minimum age for KDA activities is 14, although a specific event may set a higher minimum age. A person under 18 cannot accept this waiver for themselves. Where a participant is under 18, a parent or guardian must give consent on their behalf, confirming they have read this waiver, accept the risks described, and agree to their child taking part.
If you are under 18, ask your parent or guardian to contact us at dodgeballkuching2022@gmail.com before your first session. If a parent or guardian is there with you on the night, they can give that consent in person instead.
This waiver applies to everyone taking part in a KDA activity, including visiting players and teams from outside Kuching, Sarawak or Malaysia.
Report every injury to a committee member on the day, however minor. KDA does not treat registration as advance consent to first aid or emergency medical assistance when you are unable to consent at that moment.
KDA may photograph and film sessions and events for its website and social media. Photography, publication, opt-out requests and removal requests are governed by the Privacy Policy.
